By attending, speaking at, or facilitating for the Vermont Cheese Council’s Artisan Cheesemakers Winter Conference event (the Activity) you agree to the following terms and condition. Attendees assume all of the risks of participating in all activities, including but not limited to, any risks that may arise from the negligence or carelessness of Vermont Cheese Council (89 Mad River Green, Waitsfield, VT 05673), their subsidiaries, affiliates, directors, officers, employees, event speakers, event facilitators, sponsors, partners, contractors, agents, representatives, volunteers, successors and assigns (collectively, the “Host”). The information presented and shared is for learning and educational purposes. Attendees are responsible for the development, implementation, and individual responsibility for the cheese safety, food safety, and manufacturing practices that they and the organizations they work for implement. Attendees also understand that there may be risks involved which are not known to attendees or to the Host and may not be foreseen or reasonably foreseeable by any of us at this time or at the time of the Activity. Despite knowing these risks, attendees hereby elect to voluntarily participate in the Activity and agree to assume all related risks, including without limitation those enumerated above, and accept personal responsibility for any injury of any kind or nature that the Attendee or his/her/their property may suffer arising out of or in connection with his/her/their participation in the Activity.
In consideration for permitting engagement in or participation in the Activity, attendees agree for themselves, their executors, administrators, heirs, successors, and assigns as follows: (A) I WAIVE, RELEASE, AND DISCHARGE the Host from any and all liability, including but not limited to, liability arising from the negligence of the Host, for my death, disability, personal injury, property damage, property theft, or any other damage or actions of any kind which may affect or impact me in any way arising from the Activity. (B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the Host from any and all liabilities or claims made as a result of my participation in and information learned at the Activity, whether caused by the negligence of the Host or otherwise. This Accident Waiver and Release of Liability Form (“Release Form”) shall be construed in accordance with the laws of Vermont. This Release Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. By participating in this event, attendees are aware that their participation acts as a release of liability and contractual agreement to these terms and conditions.
